Terms and Conditions

Please read the following important terms and conditions before you use the I Choose Local platform and check that they contain everything which you want and nothing that you are not willing to agree to.

Summary of some of your key rights:

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 say that you have a 14 day right to change your mind and get a full refund on your digital content. You do not have this right to cancel once a download has started provided you have been told this and have acknowledged this.

The Consumer Rights Act 2015 says digital content must be as described, fit for purpose and of satisfactory quality.

If your digital content is faulty, you’re entitled to a repair or a replacement.

If the fault can’t be fixed, or if it hasn’t been fixed within a reasonable time and without significant inconvenience, you can get some, or all of your money back.

If you can show the fault has damaged your device and we haven’t used reasonable care and skill, you may be entitled to a repair or compensation.

Important information on downloading costs and ‘bill shock’:

When you use I Choose Local  it can download automatically onto your computer or device. Please check the file size of your content carefully as using too much data might mean that you exceed your data limit on your mobile phone and you could face paying more than you were expecting, particularly if you are using your mobile phone abroad.

 

This contract sets out:

  • your legal rights and responsibilities;
  • our legal rights and responsibilities; and
  • certain key information required by law.

In this contract:

  • ‘We’, Us’ or ‘Our’ means I Choose Local Limited;
  • ‘Subscriber’ means the person buying digital content from us;
  • ‘User’ means the person or persons invited to use the I Choose Local Limited app by a Subscriber;
  • ‘You’ and ‘Your’ may be used to describe a Subscriber or a User;
  • I Choose Local Limited app’ means the mobile app provided by Us

 

Where we use the terms ‘You’ or ‘Your’ this means that the clause of the contract in which that phrase appears applies to both Subscribers and Users of the I Choose Local Limited  app.

  • Introduction
    • When You download the I Choose Local Limited app and create an account You agree to be legally bound by this contract.
    • When the Subscriber subscribes to the I Choose Local Limited app the Subscriber agrees to be legally bound by this contract. 
    • When a User downloads the I Choose Local Limited app following an invitation from the Subscriber, the User agrees to be legally bound by this contract.
    • If You do not agree with any of the terms in this contract, You will not be allowed to buy or use the I Choose Local Limited
    • This contract is only available in English. No other languages will apply to this contract.
    • You also agree to be legally bound by:
      • our website terms and conditions
      • our Privacy Policy (see below);
      • extra terms which may add to, or replace some of, this contract. This may happen for security, legal or regulatory reasons. We will contact You to let You know if we intend to do this by giving You one month’s notice. The Subscriber can end this contract at any time by giving one month’s notice if we tell You extra terms apply. A User can terminate their use of the I Choose Local Limited  app by deleting it from their device.

  • Information We Give You
    • By law, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 say that We must give You certain key information before a legally binding contract between You and Us is made. If You want to see this key information, please:

    • The key information we give You by law forms part of this contract (as though it is set out in full here).
    • If We have to change any key information once a legally binding contract between You and Us is made, We can only do this if You agree to it.
  • Your Privacy and Personal Information

    • Your privacy and personal information are important to Us. Any personal information that You provide to Us will be dealt with in line with ourPrivacy Policy, which explains what personal information we collect from You, how and why We collect, store, use and share such information, Your rights in relation to Your personal information and how to contact Us and supervisory authorities if You have a query or complaint about the use of Your personal information.
  • Relationship between You and Us
    • Below, we set out how a legally binding contract between You and Us is made.
    • If You use the I Choose Local Platform or download the I Choose Local Limited  app you may benefit from a 30 day free trial. 
    • If you are a Subscriber:
      • All contracts are binding
      • When you place your order at the end of the online purchase process (eg when you click on the “accept contract” button we will acknowledge it by email. This acknowledgement does not, however, mean that your order has been accepted. Payment is acceptance of a cataract and acceptance of the terms of commissions paid to I Choose Local Limited where appropriate.
      • We may contact you to say that we do not accept your This is typically for the following reasons:
        • the digital content is unavailable;
        • we cannot authorise your payment;
        • you are not allowed to buy the digital content from us;
        • we are not allowed to sell the digital content to you; or
        • there has been a mistake on the pricing or description of the digital content.
      • We will only accept your order when we email you to confirm this (Confirmation Email). At this point:
        • a legally binding contract will be in place between you and us; and
        • the digital content will download automatically.
      • Once you have subscribed to the I Choose Local Limited app, you will be entitled to invite up to four (4) Users to use the I Choose Local Limited  app under your subscription.
      • If you are under the age of 18 you may not become a Freelancer of Purchaser to the I Choose Local Limited
    • If you are a User:
      • You become a User by accepting an invitation to use the I Choose Local Limited app which has been sent to you by a Subscriber. 
    • No right to cancel
      • If you are a Subscriber, when you subscribe to the I Choose Local Limited app, you will be asked to tick a box to confirm that you consent for the subscription to start immediately after you pay for the I Choose Local Limited  app subscription via the relevant app store and that you acknowledge that this means you lose your right to cancel and receive a refund for the relevant subscription term.
      • This means that you do not have the right to cancel this contract and receive a refund for the relevant subscription term unless the I Choose Local Limited app is faulty.
      • This does not affect the rights you have if the I Choose Local Limited app is faulty. A summary of these rights is provided at the top of this contract. See also clause 10.
      • This does not affect your ability to cancel the subscription without a refund in the event that you do not want your Annual Subscription Term or Monthly Subscription Term to automatically renew.
    • Permission to use the I Choose Local Limited app and the pre-populated content
      • If you are a Subscriber, when you subscribe to the I Choose Local Limited app you will see that there is already some pre-populated content.  You will not own it the pre-populated content or the I Choose Local Limited app itself.  Instead, we give you permission to use it (also known as a ‘licence’) for the purpose of you using and enjoying it according to this contract.
      • If you are a User, your ability to use the I Choose Local Limited app is dependent on the validity of the licence that the Subscriber that invited you to use the I Choose Local Limited app currently holds.  This means that if the Subscriber ends their subscription, your ability to use the I Choose Local Limited  app will end.
      • The I Choose Local Limited app that You download and use:
        • is personal to you. You can use it wherever you want in the world but only if you comply with local laws;
        • is non-exclusive to you. We will make the I Choose Local Limited app available to other users, but we will not share the data that you upload to the I Choose Local Limited  app with anyone who is not allowed to see it;
        • may not be:
          • copied by;
          • changed by you (which means, in particular, that you are not allowed to adapt, reverse-engineer or decompile it, or try to extract the source code from it, except where any of this is allowed by law);
          • combined or merged with, or used in, any other computer program;
          • distributed or sold by you to any third party, except that if you are a Subscriber you are permitted to invite up to four (4) Users to use the I Choose Local Limited app under your subscription;
        • includes a guide on how to use it. Please read this carefully. This guide is set out [insert details on how this guide can be accessed];

          • [upgrades;]
          • [new releases;]
          • [new versions;] and
        • contains information which is owned by us or third parties or both. You must not conceal, change or remove any markings which show who owns this information, such as copyright (©), registered trade mark (®) or unregistered trademark (™) markings.
      • Except where you have permission to use the I Choose Local Limited app under this clause 7, you will not obtain any rights of ownership or other rights (of whatever nature) in the I Choose Local Limited  app or in any copies of it.
    • Access to the I Choose Local Limited App
      • If you are a Subscriber and, after you have subscribed, something happens which:
        • is outside of our control; and
        • affects you being able access the I Choose Local Limited app,

please contact us using the contact details at the start of this contract so that we can help you to gain access.

  • If you are a Subscriber and your device blocks your access to the I Choose Local Limited app, you may still have the right to cancel the contract. If this happens, please contact us using the contact details at the start of this contract.
  • Payment
    • If you are a buyer you will make payment for your for the services via an in-app purchase or website which is processed via the Apple App Store or the Google Play Store or our preferred payment services provider such ad Paypal.
  • Your Consumer Rights
    • The Consumer Rights Act 2015 gives you certain legal rights (also known as ‘statutory rights’), for example, that the I Choose Local Limited app:
      • is of satisfactory quality;
      • is fit for purpose; and
      • matches its description.
    • The I Choose Local Limited app must comply with your legal rights.
    • When we supply the I Choose Local Limited app:
      • we will use all reasonable efforts to ensure that it is free from defects, viruses and other malicious content;
      • we do not promise that it is compatible with any third-party software or equipment except where we have said that it is in the guide to its use or on our website; and
      • you acknowledge that there may be minor errors or bugs in it.
    • Your Consumer Rights – If the I Choose Local Limited app is Faulty
      • Your legal rights under the Consumer Rights Act 2015 (also known as ‘statutory rights’) are set out at the top of this contract. They are a summary of some of your key rights. For more detailed information on your rights and what you should expect from us, please:

        • visit the Citizens Advice website www.citizensadvice.org.uk or call 03454 04 05 06.
      • Nothing in this contract affects your legal rights under the Consumer Rights Act 2015 (also known as ‘statutory rights’). You may also have other rights in law.
      • Please contact us using the contact details at the top of this page, if you want:
        • us to repair the digital content;
        • us to replace the digital content;
        • a price reduction; or
        • to reject the digital content and get a refund.
      • To avoid faults in the digital content happening, you must:
        • install any fixes[, updates][, upgrades][, new releases] [and] [new versions] as soon as reasonably possible after we tell you that they are available to be downloaded;
        • use it only on the recommended third party software and equipment set out in the guide to its use or on our website; and
      • End of the contract

If this contract is ended it will not affect our right to receive any money which you owe to us under this contract.

  • Limit on our responsibility to you
    • Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for any:
      • losses that:
        • were not foreseeable to you and us when the contract was formed;
        • that were not caused by any breach on our part;
      • business losses; and
      • losses to non-consumers which includes Users.
    • Disputes
      • We will try to resolve any disputes with you quickly and efficiently.
      • If you are unhappy with:
        • the I Choose Local Limited app;
        • our service to you; or
        • any other matter,

please contact us as soon as possible.

  • If you and we cannot resolve a dispute using our internal complaint handling procedure, we will:
    • let you know that we cannot settle the dispute with you; and
    • give you certain information required by law about our alternative dispute resolution provider
  • If you want to take court proceedings, the relevant courts of the part of the United Kingdom in which you live will have non-exclusive jurisdiction in relation to this contract.
  • The laws of England and Wales will apply to this contract.
  • Third party rights
    • No one other than a party to this contract has any right to enforce any term of this contract.
